The Qld Government may have finally seen reason and is likely to be implementing a change to legislation which will see the PAMD Form 30c scrapped and replaced by a regulation to incorporate the warning into proposed relevant contracts and relevant contracts.

Consequently, this will remove the requirement for a clear statement directing a buyer’s attention to the warning statement.

As a result of our submission on a review of the Property Agents Bill 2010 the Legal Affairs, Police, Corrective Services and Emergency Services Committee (LAPCSESC) has released a report on recommendations in respect to the Bills before parliament for the dismantling of the current PAMD Act.

It is recommended in the report that 'the Property Agents Bill 2010, the Motor Dealers and Chattel Auctioneers Bill 2010, the Commercial Agents Bill 2010, and the Agents Financial Administration Bill 2010, be passed' and 'the Property Agents Bill 2010 be amended to require the warning statement to be incorporated into proposed relevant contracts and relevant contracts'.

As welcome as this change will be it is a long way short of addressing the myriad of problems with current legislation. We have addressed many issues, including the benefits of incorporating warnings in sales contracts, in our submission (in conjunction with Carter Capner Law) to LAPCSESC dated 20th July 2011.
